TERMS OF SERVICES

Welcome to ImagoDraw.com. These Terms of Service (« Terms ») govern your access to and use of the ImagoDraw website, API, and editing tools (the « Service »). By using our Service, you agree to be bound by these Terms.

 

1. Account Registration

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • All activities that occur under your account.

  • Providing accurate and current information.

 

2. Use of AI Generation & Editing Tools

ImagoDraw provides AI-powered image generation and editing. You understand that:

  • Output Variability: AI is inherently probabilistic. We do not guarantee that the Service will produce the exact result you intended.

  • Availability: We reserve the right to limit « generative credits » or processing power to ensure stability for all users.

 

3. Content Ownership & Rights

This is the most critical section for an AI SaaS.

  • Your Inputs: You retain all rights to the images or prompts you upload (« Inputs »). You grant ImagoDraw a license to process these Inputs solely to provide the Service.

  • The Outputs: Subject to your compliance with these Terms and your subscription tier, ImagoDraw assigns to you all its right, title, and interest in the images generated by the AI (« Outputs »).

  • Training Disclosure: (Optional/Standard) We do not use your private, uploaded images or generated Outputs to train our base models without your explicit « Opt-in » consent.

 

4. Prohibited Conduct

You agree not to use ImagoDraw to:

  1. Generate « Deepfakes » or non-consensual sexual content.

  2. Create imagery that depicts child exploitation or extreme violence.

  3. Infringe upon the intellectual property or trademarks of third parties.

  4. Reverse-engineer the AI models or scrape data from the platform.

 

5. Fees and Payments

  • Subscriptions: Billing is processed on a recurring basis (monthly/yearly).

  • Refunds: Due to the high GPU costs associated with AI generation, refunds are generally not provided once credits have been used, except where required by law.

  • Changes: We may change our pricing but will provide at least 30 days’ notice.

 

6. Disclaimers & Limitation of Liability

The Service is provided « AS IS. » ImagoDraw makes no warranties regarding the accuracy, copyrightability, or reliability of AI-generated Outputs. We are not liable for any damages resulting from your use of the generated content in commercial projects.

 

7. Termination

We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms or engage in illegal activity.
